The src/attach.ts reorder is correct; the new test is what's failing CI (test 22/24/26), on two independent counts.
I read src/attach.ts at 8e4603f and ran test/attach-orchestration.test.js locally.
Production change — looks correct. buildCliCommand, resolveDangerousFlag, resolveDangerousEnv and splitShellWords (src/attach.ts:107, :163) are pure and touch no tmux state, so moving them ahead of tmuxNewSession/wirePipePane (src/attach.ts:353-356) is safe and does what #372 asks: an unterminated quote now throws before new-session, pipe-pane or send-keys run. This matches the existing precedent for rationguard resolution at src/attach.ts:298-301.
Test defect 1 — wrong exit code (test/attach-orchestration.test.js:194, severity: high, blocks CI).
buildCliCommand throws Error('Unterminated quote in command arguments') (src/attach.ts:102). Nothing in cmdAttach catches it, so it reaches the catch-all in main() at src/cli.ts:458-460, which prints Error: … and calls process.exit(1). The exit(2) paths the sibling --rebuttal tests rely on are explicit flag-validation calls in cli.ts (e.g. :72, :78, :174, :242), which --cli-args never goes through. CI log: Expected values to be strictly equal: 1 !== 2 at :194. Fix: assert.equal(code, 1) — or, if you want 2, validate --cli-args in cli.ts at parse time like the other flags, which is a bigger change than #372 needs.
Test defect 2 — has-session always precedes the throw (test/attach-orchestration.test.js:196, severity: high, blocks CI even after fixing 1).
tmuxHasSession(session) runs at src/attach.ts:335, before the if (!sessionExists) block where buildCliCommand now lives. So the tmux stub log is never empty; locally with the code fixed to 1 the test still fails with:
+ 'has-session -t =bad-args:\n'
- ''
has-session is a read-only probe and allocates nothing, so the PR's stated guarantee ("before any tmux resources are allocated") holds — the assertion is just stricter than the fix. Either assert the thing #372 actually cares about, e.g.
assert.doesNotMatch(stubs.log('tmux'), /new-session|pipe-pane|send-keys/, 'no tmux resources before validation');or hoist buildCliCommand(cliCmd, opts.cliArgs) above tmuxHasSession (it is called with the same arguments in both branches anyway) and keep the empty-log assertion.
With those two lines fixed the test passes locally and exercises the ordering fix as intended. Changelog fragment changelog.d/fixed-372.md reads accurately.

Non-blocking — the Mutation check, run locally against this head:
Why: the follow-up that fixed the exit code added a Suggested regression test (appended to test('attach() builds the CLI command before new-session so a bad --cli-args leaves no tmux session (#372)', () => {
// cli.js pre-validates --cli-args, so the CLI-level test cannot tell whether
// attach() itself still orders buildCliCommand() before tmux new-session.
// Call attach() directly to pin that ordering: has-session is the only tmux
// call allowed before the throw, and no new-session/pipe-pane may follow.
const stubs = makeStubs({ which: ['tmux', 'pluk'] });
const runDir = makeRunDir();
const script = `import { attach } from ${JSON.stringify(ATTACH)};
attach({ session: 'agent-badargs', runDir: ${JSON.stringify(runDir)}, noOpen: true, cliArgs: "--model 'unterminated" });`;
const res = spawnSync(process.execPath, ['--input-type=module', '-e', script], {
encoding: 'utf-8',
timeout: 15000,
env: { ...process.env, PATH: `${stubs.dir}:${process.env.PATH}` },
});
assert.notEqual(res.status, 0, 'attach() must throw on an unterminated quote');
assert.match(res.stderr, /Unterminated quote in command arguments/);
const tmuxCalls = stubs.log('tmux').trim().split('\n').filter(Boolean);
assert.deepEqual(tmuxCalls, ['has-session -t =agent-badargs:'],
'only the existence probe may run before the command is validated');

…372) The CLI-level regression only observes cli.ts's --cli-args preflight, so attach()'s own ordering was unpinned. Read src/attach.ts at 9687372 and the callers in src/cli.ts. This looks correct to me.
- The reorder in
attach()(src/attach.ts:339-355) movesbuildCliCommand()and the--dangerousassembly ahead oftmuxNewSession()/wirePipePane(). Everything hoisted is side-effect free:resolveDangerousFlag/resolveDangerousEnv(src/attach.ts:163-181) are plain table lookups, andbuildCliCommandonly callssplitShellWords(src/attach.ts:107-111). The only tmux call that can precede a throw is nowhas-session, which the new directattach()test pins (test/attach-branch-gaps.test.js:305-324). - The existing-session branch already built the command after
has-session(src/attach.ts:369), so the two branches are now consistent. - The
cmdAttachpre-check (src/cli.ts:245-254) turns the unterminated-quote case into a clean exit 2 with the flag name, matching the changelog entry.
One small note, not a defect: the pre-check only exercises splitShellWords, so --command='' (or --command="''") still reaches buildCliCommand's CLI command cannot be empty throw inside attach() — exit 1 rather than 2. It still happens before any tmux resource is allocated, so the orphan-session bug in #372 is fixed for that case too; the exit code is just less tidy. Fine to leave as-is.

#373 added a cmdAttach preflight that reports a malformed --command or --cli-args as exit 2 before any tmux call, but only the --cli-args arm was covered: removing 'command' from the loop left all 371 attach/cli tests green. Add the mirror test so the --command arm is pinned too. When attaching to a new tmux session, the code was creating the session and wiring pipe-pane before validating the CLI command and arguments. If buildCliCommand() threw an error (e.g., due to unterminated quotes in --cli-args), an orphaned tmux session with pipe-pane already attached would be left behind.
This fix moves the command building and validation to execute before the tmux session is created, so any validation errors are caught before any tmux resources are allocated.
Closes #372
