<p><h3>代缴社保</h3>

<p>代缴社保是指由于个人的原因导致公司没有为其缴纳社保，而又想购买社保，从而由代理机构（专门处理社保挂靠的公司）代理办理社保，并在其旗下公司购买社保的一种行为。按照我国劳动法、社会保险有关规定，用工单位与劳动者建立劳动关系后应当为其缴纳社会保险。而所谓的“挂靠单位”与没有单位的个人之间是不存在劳动关系的，这样的做法有伪造劳动关系嫌疑，并且在一定程度上危害了社保基金的安全。<p></p>

<p><h3>代缴社保的内容</h3>

<p>社保代缴是社保代理服务的主要内容，社保帮专为企业或自由职业者代办及缴纳社会保险，社保代缴是人事代理众多服务项目之一，社保代理作为一种中介服务，随着各地相关配套政策落实到位，越来越受到社会关注，并成为一种产业。也可以是劳动保障事务代理中的一种代理方式，指由政府人事部门所属的人才服务中心，按照国家有关人事政策法规要求，接受单位或个人委托，在其服务项目范围内，为个人或单位缴纳养老保险、生育保险、医疗保险、失业保险及工伤保险等社会保险的费用。
<p>通过挂靠参保，不仅一些重病人群、无业人员可以享受社会保险待遇，从而损害了广大参保者的合法权益，危害社保基金的安全；也导致出现了异地工作、异地参保现象，养老基金后期支付压力大。一些挂靠公司还利用挂靠人员不懂社保政策，抬高每月应缴的社保费用，除了赚取挂靠费外，还赚取每月挂靠人员缴交的社保费用的差额。

<p><h3>代缴社保的对象</h3>

<p>境内的各类企业、个体工商户、外国或外省驻当地机构及与之建立劳动关系的劳动者；
<p>机关、事业单位、社会团体、民办非企业单位及与之建立劳动关系的劳动者；
<p>流动就业人员；
<p>外国企业及华侨、台港澳企业常驻当地代表机构或分支机构及其雇员；
<p>失业人员、自谋职业的劳动者及其他在职流动人员；
<p>其他符合政策规定的单位和个人。
