require(esm) and chai v5

Hi im using node 22.12 which has require(esm) support but when I upgrade chai to v5 im getting errors...
this is my mocha script mocha --require ts-node/register --bail --recursive './tests/{,**/}*.ts'
my package.json has "type": "commonjs"

my tsconfig is as follows:

and im importing chai like this: import {expect} from 'chai'

the error i get is

am i supposed to do something special to get require(esm) working?

this is because typescript doesn't yet allow require(esm) in commonjs projects

that'll be fixed once microsoft/TypeScript#60534 is resolved
