holy crap if it wasn't for vscode bisect I would have never thought this was the issue

It creates settings.json when it changes workspace settings. When pack mcmeta check is enabled, it will change workspace settings if there is or there is not a pack.mcmeta file because it needs to change the theme. In 3.1.0 it will not create it if the feature is enabled, there is no pack mcmeta and you do not use dp icons theme there
